The Service Agreement is a written agreement that you decide as a Service Provider with your NDIS participant, on what are the expectations, rights and responsibilities for both you as the Service Provider and the client.

We should note that your client does not NEED to enter into any written agreement if they do not want to.

However, the Service Agreement is so commonly used by Service Providers as a way to clarify and describe what services and supports are to be delivered for the participant and protect the Service Provider to their rights and responsibilities should there be any incidents.

With a written Service Agreement, you can ensure that both you (the Service Provider) and the participant are on the same page.

Provider Obligations

NDIA (National Disability Insurance Agency) is not a part of the negotiation between the Service Provider and participant. However, the NDIA can interfere if it is not under the NDIS Act 2013 and NDIS Pricing Arrangements and Price Limits (check out our blog for the 2021 version of the NDIS Pricing Arrangements and Price Limits).
