All grower/processors and approved laboratories were notified that on March 4, 2023, the Commonwealth Court issued an Order temporarily enjoining DOH from enforcing § 1171a.29(c)(1)-(2) of DOH's Regulations (relating to medical marijuana), in Green Analytics North, LLC d/b/a Steep Hill PA, et al. v. DOH. The Order grants a stay of the implementation of § 1171a.29(c)(1)-(2) of DOH's Regulations, 28 Pa. Code § 1171a.29(c)(1)-(2), effective immediately and until further order of the Court. Please note that the stay is only applicable to § 1171a.29(c)(1)-(2).
On December 14, 2023, Governor Shapiro signed Act 63 of 2023 into law and it became effective April 12, 2024. Act 63 of 2023 allows qualified independent MMOs to apply for either a grower/processor (G/P) permit or dispensary permit: an independent G/P may apply for one dispensary permit and an independent dispensary may apply for one G/P permit.
Act 63 to requires the permit granted as part of this application to be issued to the business entity that holds the original permit (the permittee). Therefore, the permit will not be issued to a separate, distinct legal entity.
Although the applications are now available, completed applications will only be accepted by the Bureau between May 12, 2024 and June 12, 2024. Applications for the additional permits and supporting documentation are listed below.
